What Happens After a Positive Credible Fear Finding?

    • The applicant can apply for asylum by filing Form I-589, Application for Asylum and for Withholding of Removal.
  2. Removal Proceedings:

    • The applicant will have a hearing before an Immigration Judge who will consider the asylum application and make a decision.
  3. Work Authorization:

    • The applicant can apply for an Employment Authorization Document (EAD) while their asylum application is pending.
  4. Decision on Asylum Application:

    • If asylum is granted, the applicant will be allowed to live and work in the United States and can apply for lawful permanent residency after one year. If asylum is denied, the applicant may be ordered removed from the United States.
